On April 27, 2020, Ohio’s neighbor, Kentucky, released data showing that 46% of all of its COVID-19 deaths were residents of nursing homes. As of April 26, 2020, Kentucky reported that 610 residents and 280 employees in 60 long-term-care facilities had tested positive for COVID-19. Ninety-five residents and one employee have died of the virus.  Kentucky is now creating a long-term care task force to find ways to slow down the spread of COVID-19 inside the homes; it will also increase testing. In part, Kentucky government officials blame the number of deaths on the lack of supplies and the lack of staffing at nursing homes.  

As Kentucky’s COVID-19 numbers continue to rise, we, along with all of Ohio, would like to send our best wishes to everyone affected by the virus. 

Nursing Home Liability 

The American healthcare system has known of COVID-19 since December 2019. If you are concerned about your loved one’s nursing home’s preparation in response to learning of the virus, you have options. Every Ohio nursing home has a procedure to file a grievance. Unfortunately, the resident’s grievance will be submitted to the nursing home’s own grievance committee. The better course is to file the grievance directly to Ohio’s Department of Health, while also providing a copy to the nursing home’s grievance committee. The best action you can take is to contact an experienced nursing home attorney to advocate aggressively on the resident’s behalf.
