On April 23, 2020, it was reported that a nursing home resident who had COVID-19 was found unresponsive by her sister while in her room. The woman who found her sister was not prepared for what she saw; she stated, “the worst thing was going to the window and finding her unresponsive.” At that same nursing home, O’Neill Healthcare, 65 residents and 20 workers have tested positive for COVID-19. According to the State of Ohio, O’Neal Healthcare has the most COVID-19 cases of any nursing home in Northeast Ohio.

Our thoughts are with all of the ill as they work towards a healthy recovery

Nursing Home Liability

Ignorance concerning COVID-19 is not an excuse for failing to care for nursing home patients. Nursing home residents have the right to adequate and appropriate medical treatment and nursing care. It is neglect for a nursing home to have insufficient direct care staff on each shift to meet the needs of the residents. It is the nursing home’s responsibility to assure that it is properly staffed during the COVID-19 pandemic. A reduced staff cannot meet the needs of an elderly nursing home population. Many problems, including injury and death, can result from the lack of adequate nursing home staffing. If your loved one passed away or was injured as a result of poor nursing home staffing during the COVID-19 pandemic, you should always speak with a COVID-19 attorney in your time of need.
